Update on PA20-020 Code Amendment – Modified Development Standards for Qualifying AB 1763
In 2019, the State of California passed AB 1763, which requires cities to allow reduced development standards and density bonuses for certain affordable housing developments. In accordance with this law on March 24, 2020, the Planning Commission reviewed the proposed “Affordable Housing Projects Near Transit” ordinance. The Planning Commission recommended that the City Council adopt the proposed ordinance (3-1-1 vote).
The draft ordinance was originally scheduled for review by the City Council on April 20, 2020. However, it was later determined that additional environmental review (per the California Environmental Quality Act) was necessary. In addition, the ordinance was revised to allow for increased flexibility and case-by-case analysis of requested deviations from required development standards. As such, the Code Amendment is scheduled to go back to the Planning Commission on May 26, 2020, for consideration and recommendation to the City Council.
The revised ordinance would allow qualifying AB 1763 projects (i.e. those 100% affordable housing projects located within a half-mile of major transit) to request up to six (6) additional waivers or reductions from development standards, subject to findings, when a development standard would physically preclude a proposed project from achieving allowing density. These waivers or reductions would be in addition to the four (4) incentives/concessions provided by state law via AB 1763.
The City of San Mateo has published a Notice of Intent and Public Hearing for PA20-020 Code Amendment – Reduced Development Standards for Qualifying AB 1763. The required 20-day Public Review Period for the environmental review (Initial Study/Negative Declaration) of the code amendment began on April 30, 2020, and ended on May 21, 2020.
