Update on AB 1763 Code Amendment (PA20-020)
The City of San Mateo has published a Notice of Intent and Public Hearing for PA20-020 Code Amendment – Reduced Development Standards for Qualifying AB 1763. The required 20-day Public Review Period for the environmental review (Initial Study/Negative Declaration) of this code amendment begins on April 30, 2020, and ends on May 21, 2020. In 2019, the State of California passed AB 1763, which requires cities to allow reduced development standards and density bonuses for certain affordable housing developments. In accordance with this law on March 24, 2020, the Planning Commission reviewed the proposed “Reduced Development Standards for Qualifying AB 1763 Projects” ordinance. The Planning Commission recommended that the City Council adopt the proposed ordinance (3-1-1 vote).
The draft ordinance was originally scheduled to be reviewed by the City Council on April 20, 2020. However, it was later determined that additional environmental review (per the California Environmental Quality Act) was necessary. In addition, the ordinance was revised to allow for increased flexibility and case-by-case analysis of requested deviations from required development standards. As such, the Code Amendment is scheduled to go back to the Planning Commission on May 26, 2020, for consideration and recommendation to the City Council.
