||The final Certificate of Occupancy (C of O) was issued for 7-Eleven on Thursday, December 6, 2012. Under the current circumstances, the City did not have the legal authority to withhold issuance of the final C of O.
City staff is analyzing the use with respect to the findings noted in City of San Mateo Zoning Code sections §27.72.050 and §27.72.052.

Application for Alcoholic Beverage License
|An application for a Person-Person Transfer of License Type 21 - Off-Sale General (sale of beer, wine and distilled spirits for consumption off the premises where sold) has been made with the State of California Department of Alcoholic Beverage Control (ABC). This transfer is from S&B Productions, Inc., to 7-Eleven, Inc.
The City of San Mateo has requested a 20-day extension to the 30-day comment period to allow for review and comment on this request.

On November 15, 2012, the City Council initiated public hearings to determine if the market use is a legal non-conforming use in accordance with Section §27.72.030 of the San Mateo Zoning Code. This process requires that the item be referred to the Planning Commission for a recommendation in accordance with Zoning Code Section §27.72.052. Once the Planning Commission makes a recommendation to the City Council, the matter will be heard before the City Council for a final determination.
